Legal obligations

Under the Individuals with Disabilities Education Act (IDEA), schools are required to address elopement behavior in a student's IEP when it poses a safety risk. Elopement is a behavior of concern that warrants a Functional Behavior Assessment (FBA) and a Behavior Intervention Plan (BIP) when documented.

Schools that fail to address documented elopement behavior in an IEP are exposed to state complaint, OCR complaint, and due process claims. A student who elopes from school grounds and is injured while the district failed to have a plan in place is a significant liability event.

The terrain gap in provider settings
